November 21, 2011 - Wilmington, DE - In the latest round of protracted estate litigation involving an intra-family dispute, the Court of Chancery affirmed a decision favorable to Berger Harris's client. Vice Chancellor Travis Laster issued a ruling Monday affirming the report of Master Kim E. Ayvazian in favor of a Berger Harris client. The case, Keen v. Camac, C.A. No. 3492-MA, involved a challenge brought in the Court of Chancery to the conveyance of a 21-acre parcel of undeveloped land in New Castle County.

Berger Harris attorneys Brian Gottesman and David Anthony successfully resolved a sexual harassment claim involving liability issues that were matters of first impression in Delaware.  The case turned on whether an employer can be liable for sexual harassment based on same-sex gender stereotyping.  In 2009, Governor Markell signed into law new anti-discrimination statutes that made it unlawful for an employer to discriminate against an employee or applicant for employment on the basis of an individual’s sexual orientation.

In the August 25, 2011 issue of The News Journal, Berger Harris’ Michael McDermott is quoted regarding his representation of residents of the Town of Dewey Beach, Delaware.  McDermott's clients are challenging the Town Commission’s approval of a litigation settlement agreement that would authorize a landowner to violate the Town’s zoning code.  Specifically, the proposed settlement would permit the owner of the Ruddertowne parcel to bypass the 35 foot building height limitation applicable to every building in the Town since its 1981 incorporation.
